A parent, filing under NOI option (iii), was incorrectly sent a 2005 superintendent’s memo which included a list of approved courses the parent may choose from under option (iii). Concerned, the parent contacted HEAV for assistance. As the law changed in 2008, HEAV reached out to the district to share updated VDOE guidance on implementing NOI option (iii): “There are no Virginia statutory or regulatory requirements that govern a parent’s selection of a correspondence school or a distance learning program….no judgment of the materials is required of the school division superintendent…Submission of these materials is for information purposes only.” (VDOE Home Instruction Handbook, p.5) Following HEAV’s feedback, the district responded positively, and will no longer send this memo to parents.
