Lynchburg City

HEAV has been in contact with Lynchburg regarding correspondence indicating that parents are required to provide the following private, personal information: date of birth, grade the child is attending this school year, gender, Hispanic Y/N, and race.

HEAV explained that, in 2020, the Virginia Supreme Court reaffirmed that public school districts may not add to the requirements of the law; only the state legislature can do so. For home educators, the law does not require parents to provide information that goes beyond a child’s name, address, and age as of September 30. (Reference: §22.1-254, §22.1-254.1, Sosebee v. Franklin County School Board). The district expressed understanding of the law, and has apologized for the miscommunication.
